The petitioner seeks pre-arrest bail in connection with Bikram P.S. Case No. 251 of 2017 for the offence alleged under Section 366A of the Indian Penal Code.

The accusation is of kidnapping of daughter of the informant by Raushan Kumar with the help of ten accused persons, named in the first information report, including the petitioner.

The learned counsel for the petitioner submits that in fact daughter of the informant left the house on her own sweet will and performed marriage with Raushan Kumar, which was disclosed by the daughter of the informant in her statement under Section 164 of the Criminal Procedure Code, but, the petitioner and other family members have falsely been

Learned Additional Public Prosecutor for the State opposes the prayer for pre-arrest bail.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Bikram P.S. Case No. 251 of 2017 shall be released on pre-arrest bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Danapur, Patna, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
