JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bahadurpur P.S. Case No.205/2014 registered under Sections 302, 201, 120B and 34 of the Indian Penal Code.

The accusation is that on 26.12.2014 the informant received information on his mobile that a dead body of a lady lying near a drain at Saidpur Nahar behind Durga Temple. Thereafter the informant along with other police personnel went at place of occurrence and recovered the dead body from the drain. Learned counsel for the petitioner submits that it would appear from F.I.R itself that on the recovery of dead body of a female, Bahadurpur P.S. Case No. 205/14 was instituted on the

Patna High Court Cr.Misc. No.53088 of 2015 (3) dt.15-02-2016 basis of written report of one Prem Raj Chauhan, S.H.O of Bahadurpur police station, Patna and in course of investigation, the dead body was identified by daughter of deceased namely Jagriti Kumari, who also raised suspicion against petitioner and four others having hand in the murder of her mother. Except suspicion raised by Jagriti Kumari, there is nothing against the petitioner.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class Patna City, in connection with Bahadurpur P.S. Case No. 205/2014.
