The petitioner seeks bail in anticipation of his arrest in connection with Excise Case No. C-III-190 of 2020 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.

One Manju Devi, mother of the petitioner was arrested by the police while she was trying to dispose of liquor in order to evade her arrest.

The petitioner and another are said to have run away from the place of raid.

26.40 litres of liquor is said to have been recovered from the house of Manju Devi.

The petitioner has clean antecedents and there is no recovery from his exclusive possession. Considering the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Excise Case No. C-III-190 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
