2. The petitioners have preferred this application for grant of regular bail in connection with Chak Mehsi P.S. Case No. 20 of 2025, dated 10.02.2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 74, 109 and 352 of the BNS read with Section 3(5) of the BNS.
3. As per the prosecution case, on the alleged date of occurrence the petitioners along with other co-accused person were verbally abusing the family of informant and when the informant objected to the same, the co-accused Vikrant Kumar
Patna High Court CR. MISC. No.37816 of 2025(2) dt.24-06-2025 2/3 brought paghariya, iron-rod, khanti and sword from his house and then the petitioners along with co-accused Vikrant Kumar assaulted the informant indiscriminately. They also assaulted the family members of the informant and threatened them.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The alleged occurrence took place on 05.02.2025 but the FIR has been instituted on 10.02.2025, after a delay of 5 days without giving any explanation for the said delay. There is general and omnibus allegation against the petitioners and there is no specific allegation of any assault or overt act attributed against the petitioners. The petitioners have clean antecedent as stated in paragraph no. 3 of the bail petition. The petitioner no. 1 is in custody since 21.02.2025 and petitioner nos. 2 and 3 are in custody since 20.02.2025.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners, above-named, are directed to be enlarged on bail on furnishing bail-bonds of Rs.20,000/- (Rupees Twenty Thousand Only) each with two sureties of the like amount each to the
Patna High Court CR. MISC. No.37816 of 2025(2) dt.24-06-2025 3/3 satisfaction of learned Judicial Magistrate 1st Class, Samastipur, in connection with Chak Mehsi P.S. Case No. 20 of 2025.
7. The application stands allowed.
