03-12-2015 Heard Sri Sudhir Kumar Sinha, learned counsel for petitioners and Smt. Asha Devi, learned Addl. Public Prosecutor. Two petitioners, who are in custody since 09-05-2015 in Delha P.S. Case No. 87 of 2015 registered for the offence under Section 307 & other allied sections of the Indian Penal Code, have prayed for grant of bail.
It was submitted by learned counsel for petitioners that there is general and omnibus allegation. He submits that in respect of two murders, local people had raised protest and in that, such occurrence had taken place. Though, there is no specific accusation against petitioners, the petitioners have also been made accused and they have been taken into custody. He further submits that some of the accused persons have already been
Patna High Court Cr.Misc. No.52250 of 2015 (2) dt.03-12-2015 2/2 granted anticipatory bail by this Court, vide Cr. Misc. No. 26906/2015 and Cr. Misc. No. 35562/2015.
Keeping in view of the nature of accusation as well as the fact that some of the co-accused have been extended the privilege of anticipatory bail and the fact that petitioners are in custody since May, 2015, there is no reason to deny the prayer for bail.
Let both the petitioners namely Bhushan Manjhi and Santan Manjhi be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Jigar Shah, learned Judicial Magistrate 1st Class, Gaya/concerned court in connection with Delha P.S. Case No. 87 of 2015.
