JUSTICE ANIL KUMAR SINHA ORAL ORDER 21-12-2020 Heard Dr. Anshuman, learned counsel for the petitioner and Mr. Lakshami Kant Sharma, Additional Public Prosecutor for the state through video conferencing.
2. Petitioner seeks regular bail in connection with Bhabua (Sonhan) PS Case No. 328/2020 registered for the offence punishable under Sections 302, 201/34 of the IPC.
3. The allegation, as per First Information Report, is that the brother of informant has been killed by her uncle, aunt and cousin.
4. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and from perusal of the FIR, it would be evident that only suspicion has been raised by the informant against the petitioner
Patna High Court CR. MISC. No.35271 of 2020(2) dt.21-12-2020 2/3 and her family members. Learned counsel also submits that petitioner is the aunt of the deceased and she resides along with her family in Kolkata, which would be evident from the documents annexed at Annexure-P/2 to this petition.

Learned counsel submits that during course of investigation, it has come to light that the deceased had committed suicide in the village home and the petitioner along with her family members have falsely been implicated in this case due to ongoing civil dispute between the family members. Learned counsel further submits that the charge-sheet has already been submitted in this case and the petitioner is in custody since 03.06.2020.
6. Having regard to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is a lady and in custody since 03.06.2020 and the charge-sheet has already been submitted in this case, I am inclined to grant regular bail to the petitioner.
7. Accordingly, let the petitioner, SAVITRI DEVI @ SAVITRI DEVI PANDEY be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua

8. It is made clear that at the time of furnishing bail bonds all the parties shall follow the guidelines of social distancing.
