NILU AGRAWAL ORAL ORDER 06-04-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
Petitioners apprehend their arrest in connection with Parasbigha P.S. Case No. 66 of 2015 registered for the offence punishable under Section 302 and other allied Sections of the Indian Penal Code. The prosecution case, in brief, is that on 24.06.2015, the accused persons had killed the Bhagini of the informant by sprinkling kerosene oil and setting her on fire and thereafter they disposed of her body. It has been submitted by the counsel for the petitioners that the deceased Sonam Devi has committed suicide by putting herself on fire. It has been submitted
Patna High Court Cr.Misc. No.6300 of 2016 (3) dt.06-04-2016 2/3 that there is no eye-witness to the said occurrence. Petitioner no.1 is mother-in-law, petitioner no.2 is auntin-law and petitioner no.3 is uncle-in-law of the deceased. It has further been submitted that from perusal of paragraph nos. 12,13,27 and 28 of the case diary, it appears that there was a scuffle between the deceased and Ram Ekbal Singh, husband of the deceased, who assaulted her, resultantly, she committed suicide by putting herself on fire. It has been submitted that no specific allegation has been levelled against these petitioners.
However, learned A.P.P. for the State opposes the prayer for bail stating that petitioners are named in the First Information Report and the deceased, Sonam Devi was subjected to constant torture by her in-laws. Be that as it may, let the petitioners, named above, in the event of their arrest or surrender before the learned Court below within eight weeks from today be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Chandan Kumar, learned Judicial Magistrate 1st Class, Jehanabad in connection with Parasbigha P.S.
