The petitioners are languishing in custody for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.
From possession of petitioner no.1, a loaded country made pistol and 38 cartridges were recovered whereas from possession of petitioner no.2, 60 cartridges were recovered. Petitioners have stated on oath that they have got no criminal antecedent. They are in custody since 01.06.2020. They are ready to cooperate with the trial.
Considering the completion of investigation and no material to substantiate that the petitioners are going to tamper
Patna High Court CR. MISC. No.34230 of 2020(3) dt.22-02-2021 2/2 with the evidence, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sakra P.S. Case No. 212 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
(c) The petitioners shall not leave the country without permission of the trial Court.
