JUSTICE RAVI RANJAN ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner, the State and the Union of India.

The petitioner seeks bail in a case registered for offences punishable under Sections 20(B) of the N.D.P.S. Act. It is alleged that 4 Kg. of ganja has been recovered from the petitioner, who is stated to be in custody since 9.7.2015. It is submitted that the chargesheet has already been submitted. It is further contended that though 4 Kg. does not come under the small quantity but it also does not come in the category of commercial quantity as well which is 20 Kg and above. Learned counsel further submits that the petitioner is having clean antecedent.

No.50153 of 2015 (2) dt.10-11-2015 2/2 Having regard to the facts and circumstances of the case, the petitioner, namely, Praveen Kumar @ Tinku is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the District and Sessions Judge, Gaya in Magadh Medical (M.M.) P.S. Case No. 85/2015, with a further condition that one of the bailors of the petitioner must be his father. If the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
