ANJANA MISHRA ORAL ORDER 17-05-2016 Heard learned counsel for the petitioners and the learned counsel for the informant as well as the learned counsel appearing on behalf of the State.
The petitioner apprehends his arrest in connection with Charpokhari P.S. Case No. 237 of 2015 for the offences registered under Sections 147, 148, 149, 379, 307, 504 and 506 of the Indian Penal Code and later on, Section 302 of the Indian Penal Code was added.
After hearing learned counsel for the parties as well as the informant and on perusal of the case dairy, it appears that petitioner is one of the aggressors and the injury purported to have been inflicted by him on the informant has been found to be grievous in nature. Admittedly, there is case and counter case
Patna High Court Cr.Misc. No.6488 of 2016 (5) dt.17-05-2016 between the parties in which both the parties had received injuries. The petitioner is also said to have been injured. However, considering the materials which have surfaced in the case diary and that the case is of serious in nature in which one of the persons was also killed, I am not inclined to grant anticipatory bail to the petitioner. It is, accordingly, rejected.
