JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-08-2019 This is an application for grant of anticipatory bail in connection with Muffasil P.S. Case No. 683 of 2018, disclosing offences under Sections 147, 148, 149, 302, 120B of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution story is that in the night of 04.11.2018 while the informant was going to his native village by his motorcycle with his brother, Chandan Kumar, the accused persons named in the F.I.R. reached there and on the order of one Pankaj Singh, accused persons fired on Chandan Kumar, causing his death. It has further alleged that police arrested accused Murari Singh, who is proclaimed offender. Petitioners are not named in the F.I.R. but later on, his name transpired during the investigation.
Submission of the learned counsel for the petitioners
Patna High Court CR. MISC. No.35492 of 2019(3) dt.09-08-2019 2/2 is that they are not named in the F.I.R., but later on, their names transpired during the investigation that prior to the occurrence, deceased was seen in company of Pawan Chaudhary, petitioner and others and the said Pawan Chaudhary has been granted bail by a Co-ordinate Bench of this Court, vide order dated 11.06.2019 passed in Criminal Misc. 36036 of 2019. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned C.J.M., Begusarai, in connection with Muffasil P.S. Case No. 683 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) Sunil Shukla/- U T
