The petitioner seeks bail in Sakra P. S. Case No. 251 of 2017 instituted for the offence under Section(s) 304B, 34 of the Indian Penal Code.
Learned counsel for petitioner submits that petitioner is husband of the deceased.
It is alleged in the written report that this petitioner with other accused persons used to commit torture with grand daughter of informant for demand of dowry and gave threat to kill her. It is further alleged that on 21.6.2017 all the accused persons committed mar pit with grand daughter of informant and killed her by giving poison.
Case diary has been received.

No.33992 of 2019(3) dt.28-06-2019 2/2 Learned counsel for petitioner submits that in the case diary the statement of independent witnesses have been recorded in paragraph nos. 19 and 20, wherein, they have stated that the victim was taken to hospital by her father in-law for treatment and after her death the family members of the deceased have also participated in the funeral work. It is further submitted that in the postmortem report doctor has not assigned any definite reason for cause of death of victim.. In the written report, there is general and omnibus allegation against this petitioner.
Petitioner is in custody since 25.1. 2019 having no criminal antecedent.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM- cum Sub Judge- 13th Muzaffarpur, in connection with Sakra P. S. Case No. 251 of 2017 subject to the condition that both the bailors shall be the close relative of the petitioner.
