The petitioner is in custody in connection with Dumra P.S. Case No 180 of 2015 for the offences punishable under Sections 323, 341, 337, 354B, 504, 506 of the Indian Penal Code and 8/12 of the POSCO Act.
The F.I.R. charges eight persons including the petitioner of causing physical harassment to the informant who is a student of Class 9 in Central School, Simra in the district of Sitamarhi. It is the charge of the informant that these accused persons have been harassing her and her sisters while going to school. The petitioner is also stated to be a student.
The allegation is serious but considering that the petitioner is also a student this Court is willing to give one chance to the
Patna High Court Cr.Misc. No.50351 of 2015 (2) dt.10-11-2015 2/2 petitioner to correct himself. The petitioner has remained in custody for the offence since 29.8.2015.
In the circumstances so discussed, let the petitioner namely, Jitendra Kumar be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Sitamarhi in connection with Dumra P.S. Case No.180 of 2015 subject to the condition that in case the petitioner after his release is found involved in any further case of similar nature or in case the petitioner causes any further harassment to the informant then the court concerned shall be fully within its jurisdiction to cancel the bail bonds of the petitioner and take him into custody.
