Mr.Shailendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as Mr. Shailendra Kumar, the learned Additional Public Prosecutor for the State.

The petitioner is seeking regular bail in connection with Goraul P.S. Case No. 55 of 2023, registered for offence punishable under sections 341, 447, 448, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

As per allegation, when the informant was constructing boundary wall on his land, eleven named accused persons including the petitioner came there and assaulted the informant and his family members. The specific allegation against the petitioner is that he assaulted informant's brother namely Sanjeet Kumar on his head with sword.

Patna High Court CR. MISC. No.37066 of 2023(2) dt.03-07-2023 2/2 The learned counsel for the petitioner has submitted that there is land dispute between the parties and the injuries are simple in nature. The petitioner is under custody since 14.03.2023.

On the other hand, Sri Shailendra Kumar, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Vaishali at Hajipur in connection with Goraul P.S. Case No. 55 of 2023, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
