JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 10-03-2016 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Jhajha Police Station Case No. 74 of 2014, disclosing offences under Section 302/34 of the Indian Penal Code.
Learned Counsel for the petitioner has brought before me a webcopy of the order, dated 23.06.2015, passed in Criminal Misc. No. 2374 of 2015, whereby coaccused, namely, Dukhiya Devi @ Dakhiya Devi and Kushal Yadav, have been granted privilege of anticipatory bail after perusing the case diary.
Considering the above submission, this
Patna High Court Cr.Misc. No.5405 of 2016 (2) dt.10-03-2016 2/2 application is allowed.
Let the petitioners, namely, Guddu Yadav, Sunil Yadav and Rabindra Yadav, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar, learned Judicial Magistrate, 1st Class, Jamui, in connection with Jhajha Police Station Case No. 74 of 2014, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present himself before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
