The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, it is stated that the five named accused persons including the petitioner herein along with three unknown persons came and started to abuse and assault the informant and the members of his family. The petitioner is said to have assaulted the father of the informant with a farsa on his head leading to serious injuries. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations in the FIR are not supported by the injury report of the father of the informant which has been brought on record as

Patna High Court CR. MISC. No.45638 of 2021(4) dt.05-05-2022 2/2 Annexure-2 series to this petition. The parties are agnates and the petitioner is in custody since 4.5.2021. He has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the nature of allegation, the contents of the injury report together with the petitioner having remained in custody for 1 year, the petitioner is directed to be enlarged on bail in connection with Majhauliya P.S. Case no. 819 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah.
