JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 23-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 395, 398 of the Indian Penal Code.

Petitioner is not named in the First Information Report and the impugned order goes to show that his name surfaced in this case in the confessional statement of co-accused Mahesh Kumar.

It is further submitted that except the aforesaid confessional statement of co-accused, there is nothing against the petitioner. He is languishing in jail custody since 11.01.2019, having no criminal antecedent.
