JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the petitioner was granted privilege of bail but he made himself absent on 30.06.2014 when the record was put up for framing charge resulting cancellation of his bail bonds. Moreover, petitioner himself surrendered on 14.05.2015 and since then he is in jail custody. It further appears that charge has already been framed and the trial has commenced.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II, Gopalganj in connection with

Patna High Court Cr.Misc. No.51655 of 2015 (2) dt.16-12-2015 2/2 Sessions Trial No. 358 of 2013 arising out of Kuchaikote P.S. Case No. 155 of 2012, subject to condition that he shall attend the trial court on each and every date in person for the period of six months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
