The petitioner apprehends his arrest in connection with Udwant Nagar P.S. Case No.280 of 2015 for the offences punishable under Sections 272 and 273 of Indian Penal Code and Section 47(A) of the Excise Act.

Learned counsel for the petitioner submits that the recovery is from the motorcycle, owner of which is yet to be determined. According to the learned counsel for the petitioner it does not belong to the petitioner. He further submits that the petitioner has a clean antecedent.

Having heard learned counsel for the parties and considering the circumstances existing, let the petitioner namely, Shambhu Yadav @ Shambhu Singh in the event of his

Patna High Court Cr.Misc. No.5193 of 2016 (2) dt.31-03-2016 2/2 arrest/surrender within four weeks from today, be released on bail upon furnishing bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Ara in connection with Udwant Nagar P.S. Case No.280 of 2015 subject to the conditions stipulated under Section 438(2) of the Code of Criminal Procedure.
