Petitioner is an accused in a case registered for the offence under sections 25(A-b)a, 26 and 35 of the Arms Act. Police, on secret information, raided Dak Bangla Chouk, Motihari and arrested the petitioner armed with a loaded pistol, while his associate managed to flee away. Learned counsel for the petitioner, while refuting the allegation, submits that the allegation made in the FIR is concocted as the petitioner was apprehended from the premises of the Registry Office. Petitioner is in custody since 14.2.2019. Learned counsel for the State refers to paragraph 3 of the bail application and submits that the petitioner has criminal antecedent as he is accused in a number of criminal cases.
