The petitioner seeks bail in Salkhua (Banma Ithari OP) P.S. Case No. 147 of 2020, registered for the offence punishable under Section 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, on the alleged date and time of occurrence this petitioner along with 10 other FIR named accused persons armed with deadly weapons surrounded father-in-law and brother-in-law (Dewar) of the informant and thereafter, co-accused Ranveer shot fire on the head of father-inlaw and co-accused Santosh fired on his eyes and co-accused Manoj fired on his neck and hand, as a result of which father-inlaw died on the spot and thereafter, all the accused persons fled away. It is further alleged that co-accused Bijay Sharma
Patna High Court CR. MISC. No.46167 of 2021(2) dt.16-11-2021 2/2 inflicted knife blow on the throat of her father-in-law. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case and no specific overt act has been alleged against this petitioner. Specific allegation of firing is against other co-accused persons. Petitioner is in custody since 09.03.2021. Chargesheet has already been submitted.
Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Saharsa in connection with Salkhua (Banma Ithari OP) P.S.
