The petitioner seeks bail in Mahila P.S. Case No. 25 of 2019, instituted for the offence under Section(s) 448, 376, 511 of the Indian Penal Code and Section 6/18 of POCSO Act.

Counsel for the petitioner submits that petitioner is aged about 68 years. He has been falsely implicated in the instant case because his son is ward member and son of Bhainsur of the informant wanted for selection of Secretary. The son of the petitioner made objection in this regard. The allegation has been made against the petitioner that he tried to outrage the modesty of daughter of the informant after entering

Patna High Court CR. MISC. No.33971 of 2019(3) dt.18-07-2019 2/2 into the house. There is no statement of victim girl recorded under Section 164 Cr. P.C.

Petitioner is in custody since 6.3.2019 having clean antecedent.

Counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. 1st cumspecial Judge, Nalanda at Bihar Sharif in connection with Mahila P.S.
