The petitioner is seeking regular bail in connection with Gaurichak P.S. Case No. 765 of 2022, registered for offence punishable under Section 304(B)/34 of the Indian Penal Code.

As per allegation, the marriage of grand-daughter of the informant was solemnized with the son of the petitioner. The accused persons demanded dowry. She was killed for nonfulfilment of dowry demand. The learned Senior counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case merely because he is father-in-law of the

Patna High Court CR. MISC. No.36839 of 2023(2) dt.03-07-2023 2/2 deceased. He is residing separately from his son, having no concern with him. The petitioner is under custody since 18.11.2022. He has also submitted that his son is already in custody.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Patna City in connection with Gaurichak P.S. Case No. 765 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.

(iii) The petitioner shall remain present physically before the court below on each and every date till framing of the charge and his failure to physical appearance on two consecutive dates shall lead to cancellation of his bail bond.
