The petitioner seeks bail in connection with Singhia P.S. Case no. 86 of 2015 registered under sections 328, 304(B), 201/34 of the Indian Penal Code pending in the court of the learned Sub-divisional Judicial Magistrate, Rosera District Samastipur.
According to the prosecution case, the daughter of the informant was killed by her husband and in-laws by administering poison after assault and with the help of some unknown persons they had also disposed of the dead body by burning 3⁄4 of the body and had thrown it in the open field. It has been contended that the petitioner is
Patna High Court Cr.Misc. No.52502 of 2015 (3) dt.30-01-2016 separate in mess and business from his son since 2011 itself and has got no concern with the personal affair of the husband and wife. He is in custody since 06.06.2015 and the allegation made in the first information report is general and omnibus. Regard being had to the gravity of the offence and the nature of allegation made against the petitioner and others in the first information report, I am not inclined to grant him bail for the present.
Accordingly, the prayer for bail of the petitioner is rejected.
