2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 498A, 304B, 201, 34 of the Indian Penal Code and 3/ 4 of Dowry Prohibition Act.
3. It is a case of dowry death.
4. Learned counsel appearing for the petitioners submits that there is general and omnibus allegation against this petitioner and no specific overt act has been alleged against them, who happen to be the in-laws of the deceased. Moreover, petitioners are separate in mess and business. Thrust of allegation is against the husband of the deceased who has already been acquitted by the Trial court in Sessions Trial
Patna High Court CR. MISC. No.36880 of 2023(2) dt.01-07-2024 2/2 No.353 of 2009 vide judgment dated 27.3.2012.
5. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate Motihari, East Champaran, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
