JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-02-2019 The learned counsel for the petitioner submits that the case of the petitioner is squarely covered by the judgment dated 17.07.2018 passed in CWJC No. 1760 of 2017 (Akhilanand Singh & Ors. Vs. The State of Bihar & Ors.), hence the case of the petitioner be considered in light of the said judgment rendered by the learned co-ordinate Bench of this Court.
Patna High Court CWJC No.15587 of 2018(4) dt.05-02-2019 2/2 The learned counsel for the University submits that in case the petitioner files a representation before the respondent no.12, the respondent no.12 shall examine the applicability of the aforesaid judgment dated 17.7.2018 and in case the case of the petitioner is covered by the said judgment, appropriate relief shall be granted to the petitioner.
Having considered the argument advanced by the learned counsel for the respective parties, the present writ petition is disposed of with a direction to the petitioner to file a representation before the respondent no.12 within four weeks from today showing as to how the case of the petitioner is covered by the aforesaid judgment dated 17.7.2018 whereupon the respondent no.12 shall consider the case of the petitioner in light of the aforesaid judgment dated 17.7.2018 and pass an appropriate order within a period of eight weeks thereafter and in case it is found that the case of the petitioner is covered by the aforesaid judgment dated 17.7.2018, the services of the petitioner shall be absorbed and consequential benefits shall be granted within a further period of four weeks thereafter.
