JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner as well as learned APP.

It has been alleged that on being objected over wayward character of wife of deceased, namely, Sarita Devi, she with active involvement of her paramour murdered the deceased, Sugan Rai and dumped the dead body into the river, Gandak. The informant further informed that after having been informed at the end of his wife, he came from Patna and inquired about the incidence and during course thereof, he came to know that deceased was taken away by Pappu @ Pappu Chai as well as Sanjay Rai (petitioner) on 16.06.2014 and since thereafter, the deceased was untraceable.

From the case diary, it is evident that on having shown suspicion in the background of dubious character of wife of

Patna High Court Cr.Misc. No.31882 of 2015 (3) dt.14-10-2015 deceased as well as coming to know about the incidence but, none had claimed to be an eyewitness to the occurrence. Furthermore, none of the witnesses has also disclosed over last seen theory.

Accordingly, petitioner Sanjay Rai @ Sanjay Ray is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned ACJM, Saran at Chapra in connection with Sonepur PS Case No. 240/2014.
