JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report with allegation that he was caught when police raided the house of co-accused, Umashankar Pandey and stolen tractors were seized. Petitioner carries criminal antecedent but submission on behalf of the petitioner is that according to prosecution case itself, the alleged recovery was made from the house of coaccused, Umashankar Pandey and the aforesaid co-accused, Umashankar Pandey has already been granted privilege of bail by this Court.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.53801 of 2015 (2) dt.30-11-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Dumariyaghat P.S. Case No. 02 of 2014.
