JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 01-08-2018 On the petitioner furnishing a certified copy of this order and a Bank Guarantee to the satisfaction of the District Magistrate, Jehanabad and on furnishing two local sureties to the satisfaction of District Magistrate, Jehanabad, pending finalization of the confiscation proceedings and criminal case the vehicle in question (L.P.T. Turbo 407 [Truck]) bearing Registration No. HR-62/3953 shall be released to the petitioner in connection with Excise Case No. 1116/017, arising out of Jehanabad P.S. Case No. 676/017 after giving undertaking to produce the vehicle as and when directed by the authority concerned and not to alienate or deal with the vehicle in
Patna High Court CWJC No.10691 of 2018(4) dt.01-08-2018 2/2 question or create a third party interest during the pendency of the confiscation proceedings and criminal case or prejudice the right of the State in confiscation proceeding. The aforesaid vehicle shall be released within one week from the date of furnishing of the Bank Guarantee. Valuation of the vehicle in question shall be done as per the valuation shown in the insurance documents.
With the aforesaid, the writ petition stands allowed and disposed of.
