JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 376 of the Indian Penal Code and Sections 4 and 8 of the Protection of Children from Sexual Offences Act.

The prosecution case is that on 09.12.2015, the informant was in her house when her mother being a cook went to the school for cooking food of mid-day-meal for the students of the school when this petitioner came and ravished the informant and also gave life threatening.

It is submitted by learned counsel for the petitioner that medical report suggests that the informant was aged about 18 years when no sign of rape has been found and the informant has subsequently retracted from her initial version and also filed a

Patna High Court Cr.Misc. No.6311 of 2016 (2) dt.09-02-2016 2/2 petition to that effect before the learned court below. The aforesaid facts may constitute ground for consideration of prayer for regular bail.

Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Kargahar P.S. Case No. 320 of 2015 pending in the court of learned ACJM, Sasaram. Accordingly, the application is disposed of.
