The petitioner is accused in connection with Daudnagar P.S. Case No. 145 of 2015, registered under Sections 302/34 and 120(B) of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioner is not named in the F.I.R. and on the basis of written report of informant Balram Kumar, who is brother of the deceased, Prince Kumar, the F.I.R. was lodged against accused Mahendra Choudhary. Latter on, on the basis of the suspicion raised by the informant, during the course of investigation, the petitioner was apprehended by the Police and Police got recorded the confessional statement of the petitioner in para 26 of the case
Patna High Court Cr.Misc. No.51188 of 2015 (2) dt.11-02-2016 diary showing his involvement and involvement of the others, except that there is nothing against the petitioner. The petitioner has no criminal antecedents and he is in custody since 09.06.2015. Similarly situated co-accused, Jagannath Singh @ Jagannath Yadav, Kundan Yadav and Golden Yadav have already been granted privilege of bail by a coordinate Bench of this Court as well as by this Court vide order dated 05.10.2015 and 30.10.2015, respectively.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Daudnagar, District-Aurangabad in connection with Daudnagar P.S. Case No. 145 of 2015.
