1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Nowkothi P.S. Case no.20 of 2025 registered under sections 115(2), 351(3), 352, 303(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.
3. As per the prosecution case, the informant states that hearing hulla he came out from his house. He saw that brother-in-law of Deva Mahto namely Raunak Kumar had been caught by 2-3 persons who were abusing and threatening him. Seeing the informant running for his rescue, it is stated that the accused persons went away firing shots in the air. In the light of
Patna High Court CR. MISC. No.35652 of 2026(2) dt.01-06-2026 2/3 bulb, the informant identified the petitioner as also two others including Ranveer Kumar.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the case. The allegations are general and omnibus in nature and no person has sustained any injury in the alleged firing resorted to by the accused persons. Co-accused Ranveer Kumar has been enlarged on bail vide order dated 3.2.2026 passed in Cr. Misc. no.4603 of 2026. The petitioner is in custody since 19.8.2025 and chargesheet has been submitted in the case.
5. The application for bail is opposed by learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, no person having sustained injury in the occurrence, grant of bail to similarly situated co-accused Ranveer Kumar vide order dated 3.2.2026 (Annexure P/2) passed in Cr. Misc. no.4603 of 2026 and the petitioner having remained in custody since 19.8.2025 , the Court directs the petitioner to be enlarged on bail in connection with Nowkothi P.S. Case no.20 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with
