JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased who died within three months of her marriage. The informant being father of the deceased reported the matter stating therein that his daughter had solemnized her love marriage with the petitioner by her own sweet will but after marriage, petitioner started demanding rupees one lac and one motorcycle in dowry and when the aforesaid demand was not fulfilled, he killed the deceased and disposed of her dead body.
Learned counsel for the petitioner submits that in course of investigation, the independent witnesses stated that there
Patna High Court Cr.Misc. No.25358 of 2015 (4) dt.15-10-2015 2/2 was some quarrel between petitioner and deceased and after that deceased committed suicide. Learned counsel for the petitioner further submits that although the supervising authorities found the aforesaid fact true but even then submitted charge sheet under Sections 304B, 201/34 of the Indian Penal Code. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Bikramganj, Rohtas in connection with Dawath P.S. Case No. 08 of 2015.
