The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 20, 22, 23 and 24 of the NDPS Act.

It is a case of recovery of illegal ganja about 3.90 kg. trading from Nepal through road towards Forbesganj by the accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the name of the petitioner has transpired from the confessional statement of co-accused. He further submits that the petitioner has not been apprehended at the spot.

In the facts and circumstances of the case, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Araria in connection with Jogbani P.S. Case No. 17 of 2021 corresponding to Special Case No. 03 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
