JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks regular bail in connection with Matihani P.S. Case No. 53 of 2020 instituted for the offences under Sections 414 and 120(B) of the Indian Penal Code read with Sections 25(1-AA), 25(1-A), 25(1-B)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 07.12.2020 and charge-sheet has been submitted in the case.

Learned counsel for the petitioner submits that allegation as alleged by the informant in the F.I.R. is that at the instance of this petitioner the roof of the husk house of Vinay Singh was raided from where automatic INSAS rifle with

Patna High Court CR. MISC. No.45986 of 2021(2) dt.06-01-2022 2/2 twenty cartridges, three magazines containing sixty cartridges and forty seven spare cartridges were recovered as such total 147 cartridges were recovered from the roof of the husk house of Vinay Singh.

Learned counsel for the petitioner submits that nothing was recovered from the possession of the petitioner rather it is alleged that at his instance the recovery of arms was made from the roof of the husk house of Vinay Singh. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 07.12.2020, charge-sheet has been submitted in the case and nothing was recovered from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of Sri Rajeev Kumar, learned J.M. 1st, Begusarai in connection with Matihani P.S. Case No. 53 of 2020.
