The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273, 308 of the Indian Penal Code and 47(a) of the Excise Act. The prosecution case is that on 07.10.2015 A.S.I. of Police raided the garden of co-accused Yogendra Sah when the miscreants tried to flee away, but on chase one of the miscreants was overpowered and apprehended, namely, Bindeshwar Sah, who disclosed the names of his associates including the petitioner. From the garden of Yogendra Sah country made liquor, empty bottles and other equipments of manufacturing were recovered.

No.6398 of 2016 (2) dt.10-02-2016 2/2 It is submitted by learned counsel for the petitioner that admittedly the seizure has not been made from the petitioner and his name sprang up on the confession of coaccused. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Runnisaidpur P.S. Case No. 537 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
