ANJANA MISHRA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner, being the mother-in-law of the deceased, is apprehending her arrest in connection with Jehanabad (Mahila) P.S. Case No.57 of 2015 for allegedly having committed the offence under Section 304B/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that after the accident occurred in which the deceased received burn injuries, the petitioner along with other family members tried to take her to the hospital. In fact, she was referred by the Doctor of Anugrah Narain Medical College, Gaya to P.M.C.H., but approximately in the halfway in Jehanabad, the condition of the victim lady became serious and she was declared dead in the Jehanabad Hospital. Patna High Court Cr.Misc. No.6620 of 2016 (3) dt.13-05-2016 2/2 submits that it has come in the case diary that the petitioner and other family members administered proper treatment to the victim lady, but on account of severe burn injury, she succumbed to the same.
Learned counsel appearing on behalf of the State submits that in paragraphs 49 and 50 of the case diary said fact has come to the fore.
In view of the aforementioned facts and circumstances, let the petitioner, above named, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of `10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of Sri Hari Prasad, learned Incharge Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad (Mahila) P.S. Case No.57 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
