Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

This application for anticipatory bail arises out of Rampur P.S. Case No. 249 of 2020 for the offence punishable under Sections 406 and 420 of the Indian Penal Code. The Informant is the contractor, who has made some allegation of monetary transaction against the petitioner. The transaction has been disputed and explained by the petitioner.

There are allegations and counter allegations made by both the parties against each other, which cannot be decided

The thrust of the allegation is that the petitioner has taken loan from the informant because of various exigencies and now he is not returning the loan.

Learned counsel for the petitioner has relied upon a document executed by the informant, reading of which, speaks otherwise.

Considering the aforesaid facts as also the fact that there is no chance that the petitioner will abscond, this anticipatory bail application is allowed.

Let the petitioner, above named, in the event of his arrest/surrender within four weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Rampur P.S. Case No. 249 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
