JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 17-03-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No. 528 of 2015 punishable for the offence under Sections 385 and 387/34 of the Indian Penal Code. It appears that the informant and one Sabir Ali are found on inimical terms and cases have been filed against each other.

Learned counsel for the petitioner submits that the associate of Sabir Ali has already been granted anticipatory bail vide order dated 01.02.2016 passed in Criminal Miscellaneous No. 58637 of 2016. He further submits that the petitioner's case is on better

Patna High Court Cr.Misc. No.11428 of 2016 (2) dt.17-03-2016 2/2 or on identical footing with that of the co-accused Sabir Ali. In the facts and circumstances of the case, let the petitioner, above-named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Bettiah Town P.S. Case No. 528 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
