Mr.Uday Chand Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, Sri Uday Chand Prasad.

The petitioner seeks regular bail in connection with Nalanda P.S. Case No. 60/2015, registered for the offence punishable under Sections 147, 149, 341, 323, 307, 435, 436, 506 and 302 of the Indian Penal Code.

The allegation is regarding the husband of the informant, who was running a public school at village Neerpur having been assaulted by lathi, fists and kicks by four FIR named accused persons and 500 unknown miscreants resulting in death of

Patna High Court CR. MISC. No.46307 of 2021(2) dt.28-02-2022 2/3 the husband of the informant on account of the injuries sustained by him. The miscreants are also stated to have destroyed the school and damaged vehicles.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 24.5.2021. The learned counsel for the petitioner has further submitted that the petitioner is not named in the FIR and similarly situated co-accused persons have already been granted bail by coordinate Benches of this Court vide orders dated 8.10.2015 and 7.1.2016 passed in Criminal Miscellaneous No. 38674 of 2015 and Criminal Miscellaneous No. 45686 of 2015.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the

No.46307 of 2021(2) dt.28-02-2022 3/3 petitioner and taking into account the materials available on record as also considering the parity of the case of the petitioner with that of the coaccused persons, who have already been granted bail by coordinate Benches of this Court, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Nalanda P.S. Case No. 60/2015.
