2. The petitioner apprehends his arrest in connection with Patauna P.S. Case No. 42 of 2024, registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109, 303(2), 352, 351 (2) and 3(5) of BNS, 2023.
3. As per FIR, seven named accused persons surrounded the informant and they started assaulting him. The specific allegation against the petitioner is that he assaulted the informant at his left eye, with knife.
4. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.34509 of 2025(4) dt.12-09-2025 2/2 that the petitioner is innocent and has falsely been implicated. There is case and counter case. The petitioner has also suffered grievous injuries.
5. On the other hand, the learned senior counsel for the informant has opposed the prayer for bail and submitted that the process under Sections 82 and 83 of Cr.P.C. have been initiated. The injuries on the eyes of the informant are grievous in nature.
6. There is case and counter case. Both the parties have suffered injuries. The process under Sections 82 and 83 of Cr.P.C. have been issued.
7. Considering the above-mentioned facts and circumstances, the petitioner is directed to surrender before the court below and make a prayer for regular bail, which shall be disposed of on the day of its filing, without being prejudiced by this order.
8. With these observations, the petition stands disposed of.
