2. The petitioners are apprehending their arrest in connection with Alinagar P.S. Case No. 40 of 2019 for the offence under sections 341, 323, 307, 353, 385, 337, 338, 504, 506 and 34 of the IPC lodged on 26.04.2019.
3. As per the prosecution story, the informant alleged that due to the land dispute, after abuse, the accused resorted to assault and allegation is that on the instance of petitioner no. 1, Priyanka Devi who gave sickle to her husband Naresh Mahto. Subsequently, the assault was made on the informant and she also resorted to abuse. This led to the FIR.

4. Learned counsel for the petitioners submit that main role of assault is on Naresh Mahto, these two petitioners are family members of Naresh Mahto and have no criminal antecedent.
5. Learned APP opposes the prayer submitting that they failed to come to Court in time.
6. Though there is delay in coming to the Court, the fact remains that no specific allegation is against these two petitioners, they do not have criminal antecedent and are ladies, in that background, this Court is inclined to extend them the privilege of anticipatory bail with conditions.
7. Let the petitioners be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned SDJM, Benipur, Darbhanga in connection with Alinagar P.S. Case No. 40 of 2019 subject to the following conditions:
(i) one of the bailor should be the family member/relative of the petitioners who shall provide official document (Aadhaar Card/Voter ID Card/Pan Card/Driving License) to show his/her bona fide;
Patna High Court CR. MISC. No.37645 of 2026(2) dt.01-07-2026 3/3 (ii) the petitioners shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the Trial Court itself;
(iii) the petitioner shall be appearing before the Police Station as and when required for cooperating in the investigation;
(iv) the petitioners shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioners shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of their bail bonds. (Rajiv Roy, J) Adnan/- U T
