The petitioner is in custody in connection with Kuchaikot P.S. Case No. 79 of 2019, registered for the offence punishable under Sections 414, 34 of the Indian Penal Code and Section 30 (a), 32 (2), 38 (1), 41 (1) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case from truck bearing registration No. HR-69B3206 total 1642 liters 320 ML liters of foreign liquor was recovered. Petitioner is owner of the truck due to which he has been made accused. Learned counsel next contended that after completion of investigation police has submitted charge-sheet in

Patna High Court CR. MISC. No.34978 of 2019(2) dt.28-05-2019 2/2 the case. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 13.03.2019. Considering the facts that petitioner has no criminal antecedent and after completion of investigation police has submitted charge-sheet in the case, this Court inclined to grant bail to the petitioner , let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned A.D.J.-2nd-cum- Special Judge, (Excise) Gopalganj in connection with Kuchaikot P.S. Case No. 79 of 2019.
