1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 74, 117(2), 109(1) and 3(5) of the BNS.

Learned counsel for the petitioner submits that petitioner has antecedent of one case and the informant alleges that his sister had gone to Aapna Mart for purchasing articles when petitioner along with 3-4 named persons along with three unknown accused started passing lewd comments on his sister. Further the friend of the informant, namely, Vishal called and informed the informant about the occurrence. Accordingly, the informant reached the place of occurrence and asked the accused persons why they were eve teasing his sister where all

Patna High Court CR. MISC. No.40651 of 2026(2) dt.06-07-2026 2/3 the accused assaulted him by rod, vicket, bamboo and sharp weapon causing injury on head, hand and neck.

Learned counsel appearing on behalf of the petitioner further submits that from perusal of the allegation that alleged in the FIR it would manifest that informant alleges that he was informed by Vishal that accused persons were passing comments against his sister in market place as such he went to the place of occurrence where he was assaulted by the accused persons including the petitioner, but then the injury suffered by the injured has been opined to be simple in nature as would manifest from injury report, annexed as Annexure-P/2 to the anticipatory bail application. It is further submitted that allegation of assault is not specific.

Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail application of the petitioner and submits that petitioner has antecedent of one case and there is specific allegation alleged in the FIR that accused persons including the petitioner were passing lewd comments on the sister of the informant in a market place and the same was witnessed by Vishal who informed the informant as such informant came to the place of occurrence where he was assaulted. No.40651 of 2026(2) dt.06-07-2026 3/3 opined to be simple in nature but then it would manifest that informant suffered lacerated wound over the left temporal region of the head and also his CT Scan report depicts that he had scalp hematoma with soft tissues and bilateral maxillary sinus mucosal thickening. It is next submitted that injury may be simple but allegation is clear that petitioner along with his friends were eve teasing the sister of the informant and the informant being brother went to the place of occurrence when he got assaulted by the accused. It is next submitted that petitioner has antecedent of one case, if the privilege of anticipatory bail is granted to the petitioner, the petitioner may abscond rather will not cooperate in the investigation.

Considering the submissions made by the learned A.P.P. for the State, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner in connection with Aurangabad Town P.S. Case No. 96 of 2026 pending in the Court of learned Additional and District Sessions Judge- IV, Aurangabad/Successor Court.
