JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 16-02-2016 Heard learned counsel for the petitioner as well as learned APP for the State.
Petitioner along with Ganesh Nat and Mahesh Nat were the assailants of the deceased, Shambhu Singh whereupon prayer of petitioner for bail was rejected vide order dated 13.05.2014 under Cr.Misc.No. 6766/2014.
Apart from this, from the order impugned, it is evident that the case has been compromised amongst the parties and in the aforesaid background, prayer for bail has been renewed. Irrespective of the fact that instant offence happens to be non bailable, the court is to be guided by the evidence whatever collected during course of trial.
Be that as it may, considering the nature of allegation, I do not see any scope left for reconsideration. Prayer for bail is
