JUSTICE SANJAY PRIYA ORAL ORDER 3/ 31-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the informant. Petitioner seeks bail in Samho P.S. Case No.07 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Additional Sessions Judge, 13th, Begusarai. Prayer of the petitioner for bail was earlier rejected by this Court by order dated 12.10.2018 passed in Cr. Misc. No.57204 of 2018.

There is allegation that this petitioner along with three other accused, namely, Hemant Chaudhary, Ujit Chaudhary and Rambali Singh made firing on different parts of body of the husband of informant on account of which he died on the spot.

Patna High Court CR. MISC. No.40414 of 2019(3) dt.31-07-2019 2/2 In the postmortem report, doctor has found four firearm injuries on the deceased and death is opined due to aforesaid firearm injuries.

Report was called for from the Court below which has been received from which it appears that one witness has already been examined. It is further mentioned that trial is likely to be disposed off within six months.

Keeping in view direct allegation against the petitioner, this Court is not inclined to enlarge him on bail. Prayer of the petitioner for grant of bail is rejected at this stage.

The trial Court is directed to expedite the trial and make all efforts to conclude the same as early as possible, preferably, within a period of six months from the date of receipt of a copy of this order either fixing the case on day to day basis or by giving short adjournments and send the compliance report.
