The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 414 of the Indian Penal Code.

The prosecution case in short is that A.S.I. Sandeep Kumar Lakra recorded his statement alleging therein that on 02.11.2018 at about 10 P.M. was on patrolling duty and has got information that a stolen motorcycle is kept in the house of the Dilip Chaudhary. When reached at the place at 3.10 A.M. and searched the house of Dilip Chaudhary, during enquiry, Dilip Chaudhary discloses the name of the petitioner stating therein that such motorcycle was purchased by Golu Chaudhary 10-15

Learned counsel for the petitioner has submitted that as per F.I.R., nothing has been recovered from the conscious possession of the petitioner. The petitioner has no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Srinagar Punjaha P.S. Case No. 154 of 2018 to the satisfaction of the learned J.M. 1st Class, West Champaran, Bettiah, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
