In this case, the petitioner is seeking bail in connection with Sikti P.S. Case No. 62 of 2010 registered for offences under sections 8(c), 20(b)/23 of the Narcotics Drugs and Psychotropic Substance Act. The petitioner is in custody since 09.09.2015.

The Police has arrested Deban Mandal and from whom 25 Kgs. of Ganja was recovered and the said Deban Mandal has disclosed the name of this petitioner during confessional statement.

Learned counsel for the petitioner submits that nothing has been recovered from the possession of the petitioner and another person from whom the recovery was made, his trial

Patna High Court Cr.Misc. No.49709 of 2015 (2) dt.05-11-2015 P2/2 was conducted in Special Case No. 13 of 2010 has been acquitted from the charges.

Looking to the facts and circumstances of the case, let the petitioner, Rudranand Jha, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Araria in connection with Special Case No. 13 of 2010, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
