Petitioner seeks bail in connection with Barachatti Police Station Case No.692 of 2018 registered for the offences punishable under Sections 304(B), 201/34 of the Indian Penal Code pending in the court of learned Additional Chief Judicial Magistrate, Sherghati, Gaya.

Petitioner and his wife had left the house together on 18.10.2018. In the next morning, the dead body of the wife of the petitioner was found. Her murder was committed. The occurrence took place within a year of marriage.

The material aforesaid and no explanation from the petitioner regarding murder of his wife, excludes any other hypothesis of murder of the victim by any other person for the purpose of consideration of this

Patna High Court CR. MISC. No.38583 of 2019(5) dt.25-09-2019 2/2 application for bail. Hence, I am not inclined to enlarge the petitioner, above named, on bail for the present. The learned trial court is directed to expedite the trial and conclude the same preferably within 09 months, failing which the petitioner would be at liberty to renew the prayer before the court below itself.
