JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-01-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 272, 273, 414, 34 of the IPC, u/s 30(a) of the Bihar Prohibition and Excise Act and u/s 25(1-b)a, 26, 35 of Arms Act. .

As per the prosecution case, 172.800 liter of foreign liquor has been recovered from pick up van of this petitioner and one loaded country made pistol has been recovered from his possession.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 01.06.2021. Investigation is complete.

Considering the rival submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court concerned in Saraiya Police Station Case No. 380/2021, once the charge is framed in the case.
